Terms of Service

These terms are an agreement between you and Immortal Reality PA LLC, 6375 Penn Ave Ste B, Pittsburgh, Pennsylvania 15206, United States ("we", "us"), for your use of SizeItUp at https://sizeitup.us (the "service"). By using the service you agree to them. If you do not agree, please do not use the service.

1. Who this service is for

Anyone can play SizeItUp as a guest. To create an account you must be at least 16 years old and old enough to enter into a contract where you live.

2. What the service does

SizeItUp is a free daily estimation game: you resize a silhouette to match a reference object, and we score how close you got. We publish new puzzles on a schedule and may add, change or remove games and features.

Measurements and facts in the game are researched in good faith for entertainment. They are approximate and may contain errors, so do not rely on them for any real-world purpose.

3. Accounts

  • Accounts are optional. You sign in with Google through Clerk, our sign-in provider.
  • Keep your Google account secure. You are responsible for activity on your SizeItUp account.
  • You can delete your account at any time from your account settings in the profile menu.

4. Acceptable use

You agree not to:

  • use bots, scripts or other automation to play, or to manipulate scores, streaks or results;
  • scrape, copy or redistribute the puzzles, silhouettes or other content in bulk;
  • interfere with, overload or try to gain unauthorised access to the service or its infrastructure;
  • impersonate anyone, or use the service for anything unlawful.

5. Your data

Our Privacy Policy explains what we collect and how we use it. Guest progress is stored only in your browser, so we cannot restore it if you clear your browser data or switch devices.

6. Our intellectual property

The service, including its software, design, puzzles, silhouettes, text, name and logo, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the service for your own non-commercial enjoyment. You are welcome to share your results using the share feature.

7. Feedback

If you send us ideas or suggestions, we may use them without any obligation to you.

8. Third-party services

The service relies on third parties, including Google and Clerk for sign-in and Cloudflare for hosting. Their own terms apply to your use of their services, and we are not responsible for them.

9. Availability

We aim to keep SizeItUp running, but we do not promise it will always be available, uninterrupted or error-free. We may suspend, change or discontinue the service at any time.

10. Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We are not liable for indirect, incidental, special or consequential damages, or for loss of data, including lost game progress. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the three months before the event giving rise to the claim, or fifty US dollars (US$50). Nothing in these terms limits liability that cannot be limited by law.

11. Ending the agreement

You can stop using the service and delete your account at any time. We may suspend or end your access for a serious or repeated breach of these terms, or if we discontinue the service.

12. Changes

We may update these terms. We will change the date at the top, and for changes that materially reduce your rights we will give notice on the site before they take effect. Continuing to use the service after that constitutes acceptance.

13. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. The courts in Allegheny County, Pennsylvania have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. If you are a consumer, you keep any mandatory protections of the law where you live.
